These Terms of Service ("Terms") are a binding agreement between you and Swanson Digital LLC ("Ceko," "we," "us," or "our") governing your use of the Ceko mobile app, the website at ceko.app, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old to create an account or use the Service. By using it, you represent that you are 18 or older and that the information you provide is accurate. The Service is intended for adults and is not directed to children; we do not knowingly permit anyone under 18 to create an account or use the Service. If we learn that a user is under 18, we may suspend or delete the account. You are responsible for safeguarding your account and for all activity under it. Notify us promptly of any unauthorized use.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial use. We reserve all rights not expressly granted.
Ceko is under active development. We may add, change, suspend, limit, or discontinue any part of the Service — including features, content, virtual items, competitions, integrations, and availability — at any time, with or without notice, and without liability to you. Some features may be offered on a beta or experimental basis and may be unstable, change, or be removed at any time.

We may remove content and suspend or terminate accounts that violate these rules.
You retain ownership of the content you create and share ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely to operate and provide the Service (for example, showing your posts in feeds and to your crew). You represent that you have the rights to the content you share and that it does not violate these Terms. You are solely responsible for your User Content.
The Service includes social features — feeds, comments, direct messages, friends, crews, rivalries, and competitive "smack talk." You are responsible for your interactions with others.
No tolerance for objectionable content or abuse. There is no tolerance for objectionable content or abusive users. You can report content or users, and block other users, from within the app. We review reports of objectionable content and, where warranted, will remove the content and eject the offending user within 24 hours of becoming aware of it. While we are not obligated to monitor all User Content, we may review, remove, or restrict content and accounts at our discretion to keep the community safe.
Ceko includes progress mechanics and virtual items — experience points (XP), levels, streaks, badges, frames, cards, ranks, cosmetics, and crew and leaderboard standings ("Virtual Items"). Virtual Items are licensed to you, not sold, and you have no ownership interest in them. They have no monetary value, cannot be redeemed for cash, and may not be sold, traded, transferred, or exchanged for anything of value outside the Service. We may create, modify, remove, reset, revoke, expire, or recalculate Virtual Items, XP, scores, streaks, and standings at any time — including to correct errors or to address cheating or manipulation — without liability and without any obligation to compensate you. Any Virtual Items associated with your account are forfeited when your account is terminated or deleted.
Seasons, tournaments, rivalries, challenges, leaderboards, and crew standings are provided for entertainment and motivation only. They are not games of chance, sweepstakes, contests, or gambling, and there are no real-world, cash, or monetary prizes — any rewards are Virtual Items as described above. We may set, change, suspend, reset, or end any competition, and may adjust scores, rankings, matchmaking, or eligibility at any time, including to correct errors or address cheating, without notice or liability.
Ceko is not a medical device and does not provide medical advice. The Service offers fitness tracking, gamification, and general information for educational and motivational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any exercise or nutrition program, especially if you have a medical condition or injury.
AI-generated content. The Service includes AI-powered features — the AI Coach, which generates individualized training, nutrition, and recovery suggestions and reports from the information you log, and the AI food scanner, which estimates nutrition from photos. All AI output is generated automatically, may be inaccurate, incomplete, or inappropriate for your circumstances, and is not medical, nutritional, or professional advice. It is not reviewed by a licensed physician, dietitian, or trainer. Do not rely on it to diagnose or treat any condition or to make any medical, dietary, or health decision. You are solely responsible for evaluating any suggestion before acting on it. Apple Health and other measurements shown may likewise be inaccurate or incomplete.
No professional relationship. Your use of the Service — including the AI Coach and any workout, nutrition, or recovery suggestion — does not create a physician-patient, dietitian-client, personal-trainer-client, therapist-client, or any other professional relationship between you and Ceko, and no licensed professional is reviewing or supervising your use.
Nutrition, calorie tracking & body image. Ceko's calorie and macro tracking, food scanner, and nutrition suggestions are general estimates for information only — not a diet, meal plan, or medical nutrition therapy, and not intended to promote extreme calorie restriction, rapid weight loss, or disordered eating. They are not appropriate for everyone and are not intended for anyone who has, is recovering from, or is at risk of an eating disorder. If you are struggling with food, exercise, or body image, please seek help from a qualified professional — in the U.S., the National Alliance for Eating Disorders helpline is 1-866-662-1235.
Nutrition data & allergens. Calorie, macro, and ingredient information — including food-database entries, community- or user-added foods, and food-scanner estimates — are approximations and may be inaccurate or incomplete. Do not rely on the Service to determine whether a food is safe for you. You are solely responsible for knowing your own allergies, intolerances, and dietary restrictions and for reading product labels; never rely on Ceko for allergen or medical dietary information.
Gamification & competition. Streaks, levels, XP, leaderboards, crews, and rivalries are for motivation only — not fitness or medical advice and not a prescription to train. Rest and recovery are part of training. Do not exercise through pain, dizziness, or injury, do not train solely to preserve a streak or ranking, and stop and seek medical attention if you feel unwell.
Assumption of risk. Physical exercise carries inherent risks, including serious injury or, in rare cases, death. By using the Service, you knowingly and voluntarily assume all such risks — whether they arise from your own activity, from following any workout, program, or suggestion (including AI-generated suggestions), or from equipment or facilities you use. To the fullest extent permitted by law, you release Swanson Digital LLC from any claim for bodily injury connected to your physical activity, except injury caused by our own gross negligence or willful misconduct. You use the Service and engage in any physical activity at your own risk.
Some features require a paid subscription ("Ceko Pro"). The subscription title, length (for example, monthly or annual), and price are shown to you in the app before you purchase.
The Service integrates third-party services (such as Google sign-in, Apple In-App Purchase, Google Play Billing, RevenueCat, Apple Health, Anthropic, Spotify, and mapping/food-data providers). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
The Service lets you import or connect data from third-party apps and services (for example Apple Health, Hevy, Strong, MyFitnessPal, or MacroFactor exports). You are responsible for having the right to import or connect that data and for complying with the terms of the service it comes from. Imported and connected data may be inaccurate, incomplete, or altered during import, and we do not verify it. You import and connect data at your own risk.
The Service, including its software, design, branding, logos, and content we provide, is owned by Swanson Digital LLC and protected by intellectual-property laws. Except for your User Content and the limited license above, nothing in these Terms transfers any rights to you. "Ceko" and our logos may not be used without our prior written permission.
University and school names, abbreviations, colors, and gym or facility names shown in the Service are used solely to identify real-world locations, teams, and campuses for gameplay and social features. All such names, marks, and colors remain the property of their respective owners. Ceko is an independent product and is not affiliated with, sponsored by, endorsed by, or associated with any university, college, gym, or facility identified in the Service, including Iowa State University.
If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without obligation to you.
We respect intellectual-property rights. If you believe content on Ceko infringes your copyright, send a notice containing the information required by 17 U.S.C. §512(c)(3) — identification of the work, the infringing material and its location in the app, your contact information, a good-faith statement, and your physical or electronic signature — to our designated agent at jon@swansondigital.net. We will remove or disable access to material we determine to be infringing and may terminate repeat infringers' accounts. Counter-notices may be sent to the same address.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data, AI-generated estimate, recommendation, program, or other output will be accurate, complete, or suitable for you. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWANSON DIGITAL LLC AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR USD $100. This limitation applies to all claims, including claims for personal or bodily injury, to the fullest extent permitted by law; where such a limitation is not permitted, our liability is limited to the least the law allows. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
You agree to indemnify and hold harmless Swanson Digital LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.
These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at jon@swansondigital.net; we will try to resolve it within 60 days.
Binding arbitration & class-action waiver. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in the State of Iowa, rather than in court, except that either party may bring an individual claim in small-claims court. You and we waive any right to a jury trial and to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing us at the address above within 30 days of first accepting these Terms; if you opt out, disputes will be resolved in the state or federal courts located in Iowa, and you and we consent to their jurisdiction.
Time limit on claims. Any claim arising out of or relating to the Service or these Terms must be filed within one (1) year after the claim arises, or it is permanently barred, except where a longer period is required by law.
Injunctive relief. Notwithstanding the arbitration agreement above, either party may bring an action in court solely to seek injunctive or equitable relief to protect its intellectual property or confidential information.
Coordinated or mass arbitration. If 25 or more similar arbitration demands are filed by or with the coordination of the same or common counsel, the demands will be administered in batches (with a small number of representative cases resolved first) to promote efficiency, and the AAA's mass-filing or supplementary rules, if any, will apply.
If you download the app from the Apple App Store, the following apply: these Terms are between you and Ceko only, not Apple; Apple has no obligation to provide maintenance or support; in the event the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (Apple has no other warranty obligation); Apple is not responsible for product claims, legal/regulatory compliance, or intellectual-property claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a U.S.-embargoed country and are not on any U.S. restricted-parties list.
Google Play and other marketplaces. If you download the app from the Google Play Store or another app marketplace, your use is also governed by that marketplace's terms, and its store-specific requirements apply in addition to these Terms. The marketplace is not a party to these Terms and is not responsible for the Service, its content, or support. Purchases made through a marketplace are processed by that marketplace under its own terms.
Entire agreement. These Terms (with the Privacy Policy) are the entire agreement between you and us regarding the Service. Severability. If any provision is held unenforceable, the remainder stays in effect and the provision is enforced to the maximum extent permitted. Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. No waiver. Our failure to enforce a provision is not a waiver of it.
The Service is operated from the United States. If you access it from outside the U.S., you consent to the transfer, storage, and processing of your information in the United States and you are responsible for complying with your local laws. The Service is not directed to any jurisdiction where it would be unlawful.
We may update these Terms from time to time. We will post the updated version with a new effective date and, for material changes, provide additional notice. Your continued use after changes take effect constitutes acceptance.
